This is completely insane.

Go present it to another federal grand jury if you want, USAO. But it is crazy to ask a local/"state" GJ to indict on a fed charge and then take the indictment to fed court.

Magistrate refuses to take the grand jury return: "another first in this District." (I didn't know this could happen?)

Magistrate orders briefing "as to whether this Court has jurisdiction to return a federal indictment on only federal charges returned by a local grand jury."

The USAO then takes the indictment from the LOCAL grand jury on a FEDERAL charge to FEDERAL court.

USAO: "Hi, here's indictment to return. Just sign real quick, thx."

Magistrate: <reviewing doc> "um, wtf?"

He writes, "At a minimum, this is very unseemly; more than likely, it is unlawful."

In this case, a federal grand jury refused to indict on gun possession charges.

Undeterred, DC USAO goes to a LOCAL grand jury in DC (local) Superior Court and get the LOCAL GJ to indict on FEDERAL charge.

Superior Ct has separate grand jury process from DDC. They are different courts!

Insane things happening in the DC US Attorney's Office.

For those unfamiliar, the office handles both federal cases and nearly all of DC local criminal cases -- like a DA.

USAO got local jury to indict on fed charge and then tried to return local indictment in fed court.

Judge: Um, no.

Agreed though I wonder how many are actual trial lawyers? And have experience in EDVA where the judges will crush you if you don’t know local practice. Not a great place to be a newbie.

Speedy trial, here we come. 70 days from indictment so trial could be as soon as Dec 4. Motions practice could slow that down but there’s a strong strategy to make USAO try the case quickly if no career folks are on it and only Hallagan.

As of this afternoon, not a single career DOJ attorney has entered an appearance in the case against former FBI Director James Comey. Only the newly-appointed U.S. attorney is listed. That's extremely unusual.

I have no doubt that we will see DOJ announce a rash of investigations into Dem congressional candidates by mid 2026 - in time for midterms. I’m less sure we will see indictments because (1) DOJ has been all talk and DOJ knows courts are a check; and (2) DOJ cannot muster probable cause.
