The Land Is Inhospitable & Laurel Hell were very respectful of your ears - I would describe them as "painterly" - it's almost ironic that Nothing's About to Happen to Me has an aged painting as its cover art - Where's My Phone is fantastic but it is NOT painterly - I feel so alive rn

there is literally a multi-episode arc in TNG about respecting people who look and act in ways that we don't understand (i.e. the android Data); if stephen miller watched that arc it would probably make him very upset, assuming he has the basic literacy skills to understand it

by (1) reforming immigration (still operating under a 1952 statute) (2) allowing section 1983 lawsuits against federal officers (a vacuum created by the slow erosion of the bivens doctrine) and (3) reaffirming & clarifying 4th amendment protections in immigration enforcement

the sad reality here is that SCOTUS has spent the last half century or so carving out exception after exception for anything relating to the border - & the admin is exploiting those gray areas to their limits - only congress can permanently fix this situation

a big wrinkle here is that many of the "warrants" used in immigration enforcement are signed by article I (i.e. executive branch) judges rather than article III (i.e. judicial branch) judges - those warrants don't allow cops to enter someone's home, like a judicial warrant does

right, even a criminal immigration offense like unlawful reentry would almost never lead to probable cause on the scene - how would you know? skin color isn't probable cause, not even under kavanaugh's racist expansion of terry stops, which "only" require reasonable suspicion -

if the question in totality was "should warrants be required for arrests?" then I wouldn't know how to answer - does that mean for *all* arrests all the time, even when a crime happens right in front of the cop? for arrests that *do* actually require a warrant under current law? it's just too vague

law enforcement can make an arrest w/o a warrant if they have probable cause to believe a crime has been committed or is being committed - but probable cause is more than a hunch, & certainly more than a cop's feelings being hurt - I do not really like the framing of this question, tbh...
