The First Amendment right of access guarantees a right of timely access. And timely access requires the timely adjudication of access requests. The district court’s failure to act on our access motion, we argue, is “manifestly unreasonable,” and has the same effect as denying the motion outright.

We also argued that the justification for keeping the report secret—protecting the fair trial rights of the two remaining defendants, two Trump associates—disappeared once the criminal case against them was dismissed.

The public has an extraordinary interest in the report, which concerns allegations of grave criminal conduct by the nation’s highest-ranking official. The report's release would shed light on the scope/integrity of the Special Counsel’s investigation and the character and actions of President Trump.
