In recent years, I’ve seen a fair amount of advocacy that just… isn’t particularly moral. Or that urges extreme policy positions without any basis to believe that those policy positions, if implemented, would actually help people. I’m talking about that.

This is no time to indulge people who want to focus on self-indulgent, unstrategic, or unjust advocacy. The stakes are too high.

BREAKING: DHS Secretary Kristi Noem stares down army of Antifa and a guy in a chicken suit from the rooftop of the ICE facility here in Portland.
Noem says:
"Hey; Guy in the chicken suit. You can do better.
Too bad they are uneducated and ill-informed."
Noem isn't chicken: [chicken emoji] A view from the roof of the building. There are about 15-20 people visible in total, several of whom appear to be reporters. Most are holding signs. They aren’t even taking up the whole sidewalk. One guy is wearing a chicken suit.

Two exceedingly interesting articles from Sai Prakash (U.Va. Law) on founding-era legal interpretation. In the first, he argues that "the Founders were not textualists," frequently elevating the "spirit" of the law above its letter in ways modern textualists resist. /1

I’m thinking about this again on my walk to work this morning, which goes by the site of the Boston Tea Party and ends up a few blocks down from the Boston Massacre.

We have delineated rights in the Constitution because those arguing about it and its passage had those rights violated.

I often tell my students that I’ve litigated nearly all the amendments but they should call me if they have a Third Amendment case so I can collect the whole set.

DOJ: Yes, your honor. OR and Portland lack standing to challenge relocation of out-of-state National Guard. Only CA could possibly sue under 12406, but CA can't establish standing or irreparable harm.

Know your rights if you're approached by federal forces.
