If agents determine crowds pose a threat, they must issue two warnings before using tear gas and other types of chemical sprays, according to Ellis’ order.

Ellis: "This has been a consistent theme through all of the plaintiffs' filings: There was no warning given."

Ellis says she acknowledges that things can change quickly and be "dynamic" and that she is not present
