I think you know that I used contiguous referring to interstate rather than intrastate. The lower 48 as opposed to far flung Alaska and Hawaii that genuinely have some unique issues.

I’d caveat it to say contiguous state. Alaska and Hawaii could make arguments - but Wyoming or Rhode Island? Preposterous.

It’s not even that it’s not inherent to size. No small state (today) could plausibly argue that their small state has a particular articulable interest that justifies any special consideration. States are so homogeneous compared to any time in the past that it’s a silly anachronism.
