Earlier the government argued the 10 days of missing footage had been "irretrievably destroyed," then it argued it was lost in a "system crash." Now it says that the footage never existed at all and is therefore not "missing" and they cannot be held liable
“The Broadview video surveillance footage for October 20 to October 31, 2025, is not missing. Rather, due to a technical issue, the Video System failed to record video or audio footage during that period. Contractors manage the system for the defendants. An employee of the contractor with personal knowledge of events explained during a meeting with counsel of record how he discovered that the System did not record footage from October 20 to October 31, 2025,” the government’s attorneys wrote. “His explanation of events eviscerates any vestigial relevance of plaintiffs’ Third Set of discovery requests which assumes that spoliation occurred in this case.”

There's no consensual, uniform "real America that hates police state tactics" that's coming to prevent the US from sliding into a full blown authoritarian regime. There's just the ongoing argument & contestation amongst Americans about what powers the government we live under can legitimately wield.

Flashback to June of 1974 when a New York Times reporter went to an almost entirely white, upper-middle class retirement community in Orange County, Ca to see what folks thought of the ongoing investigation of Nixon. What they heard might ring some bells.
• "The news media is helping fan the flames of hatred for Nixon while concealing his accomplishments," said Mr. lacovo, who likes to shore up his allegations with quotes from right-wing groups like the Liberty Lobby and the Christian Crusade. He said the news media were controlled by a conspiracy of "money manipula-tors" and "international bankers" and "big money changers'' who wanted to undermine America and its traditional values. Another man who recently wrote to the local Orange County Register, a newspaper with very conservative leanings, contended that only a military coup could now save the country from an attempt by the media to destroy the President. These notions have long had currency in Orange Coun-ty, but the point worth noting in Leisure World, which attracts middle class-to-afflu-ent whites from every state in the union, is what appears to be a growing. distrust of the news media throughout conservative cir-cles. Everywhere individuals talked darkly of "the media's vendetta" against the President and alleged there was a conspiracy between the media and Democratic politicians to oust Mr. Nixon.
