FOI reveals the EHRC couldn’t even be bothered to finish an impact assessment for their new code of practice. When Bridget Phillipson asked for it on 8 October, all they managed to hand over was an unfinished “working draft”. 1/

An additional email was excluded which they applied a section 36 exemption.

This is a low volume of communications considering the vast amount we have already uncovered.

This email concerned "the Scottish Government's policy of allowing staff to use opposite sex facilities, which it has now dropped following our action", and an attachment of a letter sent to the CEO of the EHRC. 2/

The notes are heavily redacted, but they do mention that Transgender Trend had made several recommendations on "things they think could be improved in schools" The department's response was to send these to DfE to discuss "if and how to incorporate these recommendations into their ongoing work" 4/

Their official summary:

Sarah was a trans woman held in a men’s prison, kept in segregation for weeks “without legal authorisation.” She’d asked for a mental health assessment that never happened. Staff knew parole refusal could trigger a crisis, yet no suicide risk check was made.

The submission attributed to this FPA in the EIA uses phrasing like 'trans identified male' and 'male bodied', and frames the measures as protecting 'women and girls'. The document does not once mention trans men. 3/
