I agree. I never want a client’s admission to be at the whim of a CBP officer, which is a great reason to look at alternatives to B and VWP wherever possible. There were alternatives in this specific case and I bet Hyundai, LG, their subs, and every other major manufacturer wished they’d used them.

To be clear, they shouldn’t have been using the VWP to engage in productive work in the US. That said, group moves like this frequently rely on consular guidance/assistance which begs the question of whether they were directed toward the use of VWP over, say, the L program by government officials.
