Even after a court ruled Nat’l Guard deployment illegal, the admin says troops will keep patrolling U.S. cities, sometimes where locals never asked

The ILRC calls on leaders to fund real needs: affordable housing, healthcare, lower costs NOT mass deportation

The ILRC is appalled.

H.R.1 gave ICE + CBP $150B this year—plenty to keep mass detention running through the shutdown.

Congress + Trump’s admin are prioritizing militarized police, incarceration + deportation over healthcare, housing, and services for kids, elders, and low-income families.
the-ilrc.bsky.social
That means detention + deportation continue, even as WIC may run out of funding in a week & the EEOC (protecting workers from discrimination) is 90% furloughed.

But Trump’s ballroom renovations? Are still being funded.
the-ilrc.bsky.social
Immigration enforcement will continue during the gov shutdown.

Why? Because the GOP-controlled Congress made sure billions 💰 still flow to ICE + CBP—agencies deemed “essential” while programs serving families get gutted 🧵

What is denaturalization?

It’s when the gov’t tries to take back someone’s US citizenship, usually claiming they weren’t eligible when they applied.

⚖️ Only a fed judge can decide this — no agency can revoke citizenship alone.

This is a moving target and people should remain informed!

DACA applicants and those interested in DACA should consult with an attorney to assess their case and any risks associated with their case.

#daca
the-ilrc.bsky.social
What does this mean for DACA recipients today?

1️⃣ The status quo HAS NOT changed; DACA renewals continue
2️⃣ USCIS IS NOT processing initial DACA applications at this moment
3️⃣ There will not be a decision in the DACA case before Oct. 27
the-ilrc.bsky.social
This did not change anything and the status quo of DACA continues. There will be more briefs submitted in the coming days with response briefs due on Oct. 20th and final replies to those briefs due on Oct. 27th.
the-ilrc.bsky.social
On Monday, September 29, the government filed a brief in the DACA litigation responding to questions that Judge Hanen had previously raised. 🧵

CORRECTION ‼️

The Sept 30 date is the date USCIS starts assessing the fee. USCIS will send individual notices of when to pay, how to pay, and consequences for failing to pay.

And EOIR has not indicated a September 30th deadline.
the-ilrc.bsky.social
🚨 Practitioner update:There’s confusion about whether EOIR asylum annual fee is due today

👉 The Sept 30 date applies to USCIS (end of FY)
👉 EOIR has no mechanism to pay the annual fee — the portal only accepts initial filing fees
👉 EOIR has not issued guidance yet
We hope EOIR provides clarity soon

Nearly 60,000 ppl are currently detained — the highest levels in yrs. Families & advocates say these conditions cause lasting harm & undermine basic dignity. (4/4)
the-ilrc.bsky.social
New policies have made it harder for people in detention to win release — even when judges rule in their favor. “Automatic stays” & expanded detention keep ppl locked up longer. (3/4)

In Georgia, a man died awaiting surgery. In CA, a pregnant woman miscarried after being denied adequate prenatal care & placed in restraints.

39 y/o Ismael Ayala-Uribe, a former DACA recipient, fell ill in Adelanto after a workplace raid. He later died awaiting surgery. (2/4)

⚠️TW: death, miscarriage, neglect in detention

This year has been the deadliest in ICE detention since 2018. Advocates are raising alarms about preventable deaths, rising suicide attempts, & lack of medical care.

Intentional disruption in the immigration courtroom has been a weapon of the Trump admin resulting in shocked attorneys with cases suddenly lost in thin air.

Courts have ruled that detainers are *REQUESTS*.

Advocates argue that sanctuary policies build trust between immigrant communities & local police, while ICE’s approach stokes fear & constitutional concerns.
the-ilrc.bsky.social
ICE accused the states of “obstructing” enforcement, demanding they honor thousands of detainers

States pushed back ✊🏽:
CA: state law bars honoring detainers w/out a conviction for select crimes
NY: requires judicial warrants
IL: TRUST Act bars holds w/out a judge’s order
