They literally gave us a list of things to teach and be examined on. Then designed an exam that penalises pupils for using things that are on the list.

Pupils in the toilets during lesson time are not supervised in any way. It's no good pretending they are.
And yes, duty staff go into toilets if they have to.

The toilet thing is quite simply a legal duty that pupils are not unsupervised.
(At break and lunch there are teachers on duty. During lessons teachers are on classrooms and so are pupils.)
