If he genuinely is talking about a rental property in which the owner has $100,000 of equity, the owner will make $100,000 if they sell it and no-one should be shedding any tears over having to pay tax on that income the same as wage/salary earners have to pay tax on theirs.

This has the usual "Parliament is sovereign" problem. Only Parliament can give someone the power to override Parliament, which means Parliament can also remove their power to override Parliament. Maybe they forgot which country they're in.
