But that would only be true if he'd *concurred* on the narrow basis that the court shouldn't be deciding difficult questions on the shadow docket. Instead, he's *dissenting*, which means he wants to grant emergency relief. He's playacting moderation by flipping the emergency standard on its head.

That's exactly his position. He's acting as though his opinion is somehow more moderate than the majority because he wouldn't have decided these questions on an emergency basis.
