One neat thing you learn as a civil litigator is (a) there's a constitutional right to jury trials in civil cases (b) which is never enforced and federal courts laugh at you for citing it, and (c) there are a hundred bajillion judicially-created doctrines to stop you from getting to a jury trial.
An excellent point that is too often overlooked. A lot of this “law” is not real or tethered to statute—it’s judicially manufactured. The only solution to that is to improve the composition of the judiciary. (And that’s both the federal *and* state judiciaries, since state judges pull this, too.)
