The use of a chemical irritant when the person was detained on the ground, even if not handcuffed, is an excessive use of force. It’s also a criminal violation of Battery.

Bonuses for reaching a quota, or for arresting people who are citizens or documented is antithetical to law-enforcement principles. The use of excessive force on persons and the unnecessary damaging of private property is contrary to the oath of all law enforcement officers.

Do not forget that Mr. Bovino was found to have falsified a police report by a federal judge in Chicago. That should result in his termination immediately.

Approximately a month to six weeks ago, Bovino was found to have falsified a report. That is typically grounds for removal of any sworn law enforcement officer, and that should be considered in this case.

Law enforcement officers are obligated to administer first aid to any individual upon whom they have used force. ICE officers should have provided medical assistance prior to any ambulance or other EMS arriving.

In another review of a video, the officer firing his weapon also had a fellow ICE officer in the line of fire.

From an initial review of one of the videos, it appeared a person was standing several feet away from the rear of the SUV where the woman was shot. That person behind the SUV was in the line of fire and officers are taught to make sure others aren’t placed in danger when their weapons are used.

Law enforcement officers are taught to not place themselves in front of a vehicle that if driven would place the officer in jeopardy. And the officers have an ethical obligation to medically assist people upon whom they have used force, especially deadly force.
