Courts bar folks from enforcing their rights unless Congress says they can.

Yet when Congress says they can, courts bar folks anyhow by creating and applying immunities - here, #QualifiedImmunity & #SovereignImmunity.

And Congress DID provide a damages action for @IJ.org’s clients in Martin v. U.S.

This action is enshrined in the FTCA and applies to federal police.

In fact, the FTCA waives #SovereignImmunity, but the 11th Cir. put it back!
