The House Ways & Means' budget bill terminates the tax credit for clean vehicles (including EVs) early, starting in 2027 instead of 2033. It also provides this curious provision which appears to mean that for taxable year 2026, only Teslas will not be eligible for this credit?

11 (b) SPECIAL RULE FOR TAXABLE YEAR 2026.—Sec12
tion 30D is amended by inserting after subsection (g) the
13 following new subsection:
14 ‘‘(h) SPECIAL RULE FOR TAXABLE YEAR 2026.—
15 ‘‘(1) IN GENERAL.—With respect to any vehicle
16 placed in service after December 31, 2025, such ve17
hicle shall not be treated as a new clean vehicle for
18 purposes of this section if, during the period begin19
ning on December 31, 2009, and ending on Decem20
ber 31, 2025, the number of covered vehicles manu21
factured by the manufacturer of such vehicle which
22 are sold for use in the United States is greater than
23 200,000.
24 ‘‘(2) COVERED VEHICLES.—For purposes of
25 this subsection, the term ‘covered vehicles’ means—

1 ‘‘(A) with respect to vehicles placed in
2 service before January 1, 2023, new qualified
3 plug-in electric drive motor vehicles (as defined
4 in subsection (d)(1), as in effect on December
5 31, 2022), and
6 ‘‘(B) new clean vehicles.
7 ‘‘(3) CONTROLLED GROUPS.—Rules similar to
8 the rules of section 30B(f)(4) shall apply for pur9
poses of this subsection.’’.
