If it’s extradition, Art 3 might apply because the state is working *with* the other state to torture the individual, but I think Soering is the absolute outer limit of the Art 3 obligation. If its expulsion or deportation, Art 3 as drafted doesn’t apply.

The problem arises from the text itself - Art 3 is absolute. That makes sense where it is concerned with (a): the state can never torture. It can’t be concerned with (c), which is failing to prevent, others committing torture because that can’t be absolute. (b) is Soering, which I think is right but

In any event, I don‘t think there is any (much less longstanding) common law right not to be expelled from the UK where one would face a risk of torture. In Soering v UK the domestic courts where perfectly happy to let someone be extradited in a way the ECtHR said might involve breach of Article 3.

It’s a Soering point. If the state is going to kill or torture you, no extradition. Alternatively in limited circs a blatant breach of fair trial may have the same effect.

1. It is well-established from European Court of Human Rights case-law (Soering) that (in these cases) the court must decide the question of safety itself. So Howard is wrong about that. (NB that this is a key reason why the Rwanda Bill is problematic from an ECHR perspective.)

possibly because I did my learning before the mid 1990s, I’d say the older interstate cases (Ireland v UK, Cyprus v Turkey) the “extra territorial” cases (East African Asians; Soering) and the “in accordance with the law” cases like Malone were foundational for the court’s authority and approach
