I still think the Trump DOJ is failing to produce competent witnesses here more out of incompetence than out of contempt — the lawyers in charge just cannot navigate agency structure and law. But as Judge Xinis’s “two strikes” comment suggests, they’re running out of time to learn their jobs.

An “administrative” stay after oral argument? WTF is that?

Preserving the status quo before the TRO is a description of what they’re doing; it’s not a reason for doing it, & it’s not a legally sufficient reason for action or there would be no such thing as a TRO.

Say what you will about red states & blue states, but there's one way in which California law & policy have always been & apparently always will be superior to all others: no one can own the beach, and beach-adjacent landowners must allow the public to have access to the beach.

When people ask about my part of town, I tell the story about the terrorist stabbing attack at Borough Market a few years back & the guy who put down his pint, stood up, and yelled, "Fuck you, I'm Millwall!" before attacking the attackers with his bare hands.
