I was thinking of stuff like lying about having had a vasectomy or something to convince someone they can have unprotected sex with you, which I don't think would fall under the same definition, but almost certainly should.

The point I'm making is merely that this judgement is *specifically and maliciously* transphobic, because no one in history has ever been jailed for pretending to be in a band to get laid or something. If the criteria is simply deception, where do you even start?

And the framing is deliberate, particularly the contrast in all the articles between the made-up, filtered, dating app photo and how she looks more recently. The implication is barely implicit at all there.

As I say, this thought experiment is just one of those annoying gotchas, really, because there is no chance this case informs any other kind of consent-via-deception situations. It isn't about a better, more nuanced understanding of sexual consent, it's about Ew Trans Women.

"Buyer beware" and all that. You can lie about not having an STI, lie about using contraception, lie about your name, your past, your job, anything you like. Most people consider that part and parcel of interacting with others. Some people are liars; deal with it.

But should it be a *crime*? Should it be classed as *rape*? If someone pretends to be rich to seduce someone, are we calling that rape too? I don't think we should, and I think most people - including those crowing about the imprisoned trans woman - would find that laughable.

And it's not unfair to say that, well, people probably *shouldn't* be tricking anyone like that actually - everyone should go into a sexual encounter knowing all they feel they need to know and not regret sleeping with someone afterwards because of stuff that was withheld.

It won't matter and it isn't the point - transphobia is the point and that's all it is - but if we're going to define rape as gaining sexual consent by deception, that opens up an awful lot of totally normal situations to prosecution. Lots of people lie to get someone into bed.

I actually get more annoyed when people say they “just” use AI for their emails or to check their grammar. You’re killing people. For your banal shit. Not for some great discovery or curing cancer. Because you can’t write an email.
