A couple of years ago, the Democrats in the Oregon legislature passed a domestic terrorism law over of the objection of civil liberties advocates, environmentalists, and ordinarily reasonable Oregonians who told them this would only be used against the left.

It fits right in with Trump’s strategy.

This is why we collectively needed to reject the terrorism framework long ago. There is no equivalent to the counter-terror framework in eroding rights and legal norms.

Every “counter-terror” response has been an act of overreach that paints an entire community as guilty.

And, for the record, and to my great shame and dismay (but holding myself to account), no judge asked why they were hearing a stay motion for an appeal of a TRO, which isn't appealable in the first place.

The coming national horror is that if Portland's *truly* minimal level of protest justifies federalizing and deploying troops, they can and will be federalized and deployed anywhere the President wants and whenever he wants.

My initial read on this argument: Judge Nelson is eager to disagree with his 9th Cir. colleagues that federalizing the NG is reviewable at all.

He's also eager to disagree with Judge Immergut that the Portland protests were small and under control.
