The International Court of Justice will open public hearings in the genocide case brought by the Gambia against Myanmar next week.

Here is the first of what I hope will be a series of analytical pieces on some technical legal issues which the Court may wish to address.
With public hearings in the Gambia v. Myanmar ICJ case beginning on Jan. 12, @adhaque.bsky.social argues that consideration of an inference of genocidal intent from a “pattern of conduct” is not exclusive of other sources of evidence to establish intent.

Over at the ICJ, Myanmar is complaining that the Gambia is seeking to reverse the burden of proof in the case involving alleged acts of genocide committed against the Rohingya.

Imho the Gambia's expert witness (Professor Michael Newton) was devastating and Myanmar's cross-examination was a disaster. We'll see if the Court agrees.

I don’t think we should see this Board of Peace agreement as a treaty in the traditional sense, concluded between sovereign states. Just like trade deals, it is concluded personally with Trump, as a performative sign of allegiance to him, with obligations owned to him, and contributions paid to him.

In May, I told Rubio that locking up students for exercising their free speech rights was outrageous & unlawful. He scoffed.

Now, a judge has said he & others engaged in an “unconstitutional conspiracy” to take away those rights.

We must defend our freedoms at every turn.
