Their waists and hands were tied together, forcing them to bend down and lick water to drink. The unscreened bathrooms contained only a single sheet to cover their lower bodies. Sunlight barely penetrated through a fist-sized hole, and they were only allowed access to the small yard for two hours. Detained by US immigration authorities for eight days, the workers and their families expressed shock, describing human rights violations and absurdities they could not have imagined as ordinary Koreans living in 2025.

Kavanaugh's concurrence cites as examples two immigration cases in which the Court held that lower courts lacked the power to block Biden administration immigration policies.

What he rather curiously omits is that, in both cases, the Court had *denied* the government's emergency applications.

One might also add examples of stuff Biden did that lower courts blocked and that #SCOTUS *left* blocked at the emergency application stage, only to unblock on the merits (e.g., rescission of MPP; immigration enforcement priorities).

Those seem like the sharpest examples of differences in behavior.

What happened at SCOTUS today is alarming: The right-wing majority allowed the Trump admin, as part of its sweeping immigration raids, to racially profile Spanish-speaking people who look Latino at certain low-wage job sites in the Los Angeles area while litigation challenging the raids is ongoing.

INTRODUCTION
1. This is an emergency complaint accompanied by a request for a temporary
restraining order on behalf of hundreds of Guatemalan children at imminent risk of unlawful
removal from the United States.
2. Plaintiffs are ten (10) unaccompanied minors from Guatemala between the ages
of 10 and 17 whom Defendants are seeking to remove from the United States in clear violation
of the unambiguous protections that Congress has provided them as vulnerable children.
Plaintiffs have active proceedings before immigration courts across the country, yet Defendants
plan to remove them in violation of the Trafficking Victims Protection Reauthorization Act of
2008, the Immigration and Nationality Act, and the Constitution.

Exactly right. ICE routinely brings people back after mistakes. Even still, today! But with him, it was the CECOT deportation flights. It was their defiance of Judge Boasberg. And when his removal threatened to blow up their narrative, they turned the full weight of the federal government on him.

As we at the American Immigration Council laid out in a recent report, Trump’s second-term immigration policies, in just six months, represent an unprecedented and coordinated assault on democratic rights and principles. We are now witnessing the routine violation of rights that most Americans consider fundamental.

Despite the First Amendment’s guarantee of free speech, the administration revoked student visas because of their political opinions. Despite the Fourth Amendment’s protection against unreasonable searches and seizures, ICE uses secrecy and sometimes deception to detain immigrants and even U.S. citizens in public spaces. And despite the Fifth Amendment’s promise of due process, the administration sent hundreds of Venezuelan men to El Salvador’s hellhole CECOT prison, based on vague, unchallengeable allegations of gang affiliation.

The Trump administration’s immigration policies aren’t just violating individual rights; they are also an attack on the constitutional structure that upholds American democracy. This system of checks and balances exists to ensure that no single branch or leader can act with unchecked power.
