Trump v. US has destroyed my willingness to ever say with any certainty that a case is too clearcut. I think it's more likely than not that they uphold birthright citizenship, but that's it. Weighted coin toss at most.

The only problem with this argument is that there have been other instances where a case was a slam dunk on both the law and the “we’re not Trump’s lackeys!1!” aspect and… they ruled for the patently absurd argument anyway. Not holding my breath here.

1) The justices' behavior at argument (with Kagan, Barrett, and Gorsuch all focused on ensuring the SG would appeal a loss so that the merits *would* come back to the Court); and
2) The SG's behavior since then, which is most pointedly *not* trying to win on any ground.

I understand, as well as anyone, why folks are cynical about #SCOTUS. But even from the conservative justices' perspective, the birthright citizenship case is easy. And the Justice Department knows it, too; as I wrote in September, its bevavior in these cases has just been going through the motions:

It's going to take the USA generations to regain some semblance of prosperity, and I doubt we'll ever be on top of the world again after all this shakes out. Like Great Britain before us, I think we're about to start our decline.
