If you're looking for more reasons to detest the #Greenland move, consider this: 90% of inhabitants are indigenous.
A repeat of the 1867 Alaska Purchase, a transaction between U.S. & Russia that ignored native (Tlingit, Inupiat, Yupik) sovereignty entirely.
We're redoing the 19th century, folks.

This "height of irony" is what Alito and company rely on to conclude that rights to (for example) privacy and bodily autonomy don't exist: X was forbidden in the past, so this shows there's no right to X.

Isn't that the height of irony?

I've just posted a draft essay called "Tradition Without Text?" (forthcoming in Duke Law Journal Online). It critiques Dobbs for using crude positive-law proxies to identify "historical understandings of ordered liberty."

I can recall a time when I would've gotten a screen saying the National Archives' website was down and thought, "huh, guess it's just a technical glitch," and moved on.

Book recommendation: "The Worst Trickster Story Ever Told" by Keith Richotte, Jr.

This is a wonderful and *highly* entertaining account of the development of Indian law.

I learned a lot!!!

People saying this Venezuela action will facilitate the application of the Alien Enemies Act to Venezuelans in the USA have it exactly backwards.
With the #Maduro regime now toppled, shouldn't the Venezuelans held under the Alien Enemies Act be entitled to immediate release?
A legal predicate for invoking that law was that the Tren de Aragua gang was an arm of the Maduro government.
If that was ever true, it surely can't be now.

In his year-end report yesterday, Chief Justice Roberts referred to "the overruling of Plessy [v. Ferguson] in Brown v. Board of Education."

*Didn't happen.*

In Brown, the Court announced that henceforth "in the field of public education the [Plessy] doctrine of "separate but equal" has no place."
