It'll never be entirely clear to me why they didn't have this stuff ready to go right out of the gate in December 2023, and why they didn't make Duda veto it enough times to force PiS to own the sense of stagnation. Maybe now they'd have a more cooperative president in office.

Poland’s justice ministry has unveiled new plans for how to deal with the status of around 2,500 judges who were appointed by a body rendered illegitimate by the judicial reforms of the former PiS government, as well as rulings issued by them.

The Tusk government will likely have to resort to using "bad tools" left by their predecessors (such as the power of the parliament to appoint most of the judicial council) to get anywhere until perhaps after 2030 Poland will have another shot at comprehensive reform of the judiciary. 9/

Making matters worse is that the binary state of Polish politics means that chances for a compromise that would satisfy Nawrocki while including enough content to make it an actual stab at repairing the rule of law are also vanishingly small. 8/

What next? The draft will be discussed and proceeded, but the chances that the President, who has one aim: to make PiS return to power in 2027, will agree to a bill that seeks to undo damage done by PiS are, well, very low. 7/

Minister Żurek was appointed to hyper-charge the rule of law restoration process after the "timid" Minister Bodnar did things the slow way, but I wonder just how of this frenzy of activity is getting us closer to some progress and how much is political flexing of muscles. 6/

Other solutions aren't that great, such as having most of the "neo-judges" undergo a repeat procedure before a "repaired" National Council of Judiciary. Problem is, the views towards restoring the Council's independence are rather remote at this point. 5/

Some elements of the draft are things I support 100%, such as removing all the neo-judges from the Supreme Court and abolishing the highly problematic Extraordinary Control and Public Affairs Chamber of that Court. 4/

In elaborating this new/revised draft, MoJ Żurek decided to forgo consulting it with the Venice Commission. I'm not sure why the haste, chances that this draft will come into force are pretty much zero due to opposition from President Nawrocki. 3/
