@dicknixon.bsky.social Put aside Brooks’s ‘11 Epstein visit.

He just sucks at his job. He genuflects the vibe percolating in semi-elite circles. That’s it.

It’s problematic that Dems like Obama ever took him seriously.

US states did have deep infrastructure delivery expertise—when the federal government guaranteed long-term funding, standardized delivery, and absorbed risk. That capacity eroded precisely after the neoliberal turn of the early 1980s...1/2

They Are a Political–Fiscal Design Problem

Pretty notable, in my view, that Kagan points out the Supreme Court's pro-gerrymandering decision in Texas is a step-by-step instruction manual for states to draw discriminatory maps while ducking judicial review, and the majority has...nothing to say in response www.supremecourt.gov/opinions/25p...

@noahfeldman.bsky.social So, have you learned your lesson or are you gonna double down next time and tell us not to worry about nominees like Aileen Cannon or James Ho?
As Justice Kagan begins her dissent by pointing out, what is even the point of trial, of fact-finding, of clear error, of standards of review, when the Supreme Court simply ignores every single part of that and decides everything purely on the papers without any real consideration of the facts?
