I've actually been doing some research on this. Looking at all the examples people cite this is like...and I have a question for the @democrats.senate.gov intern they'll never answer.

Yes it should be invoked but the only people who can invoke it are either the VP or the cabinet and the first thing everybody did was ensure thats not gonna happen.
