JUST IN: A federal judge has barred ICE and DHS from using taxpayer information provided by the IRS.

Judge Talwani says that DHS' view that noncitizens lack 4th amendment rights — combined with ICE use of administrative warrants — is a recipe for abuse.

Among (lots of) other things, this is going to flood the federal courts of appeals with cases in which the BIA might previously have cleaned up the IJ's messes.

When something like this happened in 2004, the circuit courts ... did not respond favorably to the government's positions in those cases.
🚨HOLY CRAP. The Trump admin just took a SLEDGEHAMMER to due process, largely eliminating the Board of Immigration Appeals process and MANDATING DISMISSAL of ALL appeals (which cost $1,000 thanks to OBBBA) filed after tomorrow unless a majority of the BIA votes to hear the case.

SAVE Act has nothing to do with voter ID, that's not in there. It creates deliberately difficult hurdles for registration to vote, where a DL-type ID isn't sufficient. But states that don't check ID at the polls would not be required to start. Every time they claim it's a "voter ID" bill is a lie.

LEAVITT: What he's suggesting is that Republicans and Democrats in Congress should pass the Save America Act. It will require voter ID to vote and proof of citizenship to register to vote.

The appeal to the federal circuit court ALSO costs $600. So now anyone who loses in immigration has to pay $1,000 to be automatically denied in nearly every case, and then $600 to seek an emergency stay of their imminent deportation.

AND THIS APPLIES EVEN TO PEOPLE IN DETENTION.

The goal is clear; mass deportations over due process.

An order of removal does not become "final" until the Board of Immigration Appeals denies an appeal. After that, ICE can deport the person unless they file ANOTHER appeal to a federal circuit court AND get an emergency stay.

The Trump admin is ALSO changing the rules so that rather than 30 days to file a Notice of Appeal, people will now only have 10 days (in most cases).

That's just 10 days to find $1,000 and appellate counsel for an appeal the government says it will likely automatically deny!

As far as I know, this is DHS's first effort to explain their position that I-205 forms allow entry into the home. They rely on the dicta in the 1960 Abel case (before Payton) and re-imagine the plurality opinion in Lucas as if it were the majority (and then overrely on it).

Great read. An ICE attorney working for DOJ temporarily explains that ICE has no clue how all of this "federal court" stuff works and makes clear that both ICE and DOJ were totally unprepared for the flood of habeases that were the inevitable result of the Minneapolis raids.
