Mortgage fraud they obtained data covered by the privacy act. It was illegally accessed and provided to the DoJ. The FBI retained data from a search of Comey's lawyer that should have been destroyed. They then did an illegal search on data they never legally had a right to. Both criminal acts.

Both cases uncovered criminal activity to get the indictment. It wasn't that they were just BS but apparently the DoJ decided it was OK to break the law to justify the BS.

The intent was pure malicious harassment. To inflict inconvenience and legal fees on the plaintiffs. There was never a reasonable case against either.
