Saisi, le @cdjm.org vient de rendre un avis : « le recours à des menaces de divulgation d’informations confidentielles […] caractérise une méthode déloyale et une intention de nuire. »
Une heure et seize minutes plus tard seulement, en l’absence de réponse, le ton change et se fait menaçant dans un nouveau message, également reproduit dans l’article. Il commence par informer le contributeur de procédures judiciaires possibles : « Nos avocats examinaient depuis des semaines les suites à donner au harcèlement coordonné dont Le Point est la cible. » Puis l’auteur menace : « Nous allons faire un article sur vous, sur notre site, en donnant votre identité, votre fonction, en sollicitant une réaction officielle de [nom de ses derniers employeurs connu du contributeur FredD, ndlr]. » M. Seznec fixe ensuite un ultimatum au lundi suivant à midi pour obtenir une réponse. Le CDJM considère que le ton utilisé par l’auteur n’est pas en adéquation avec la prudence qu’on est en droit d’attendre d’un journaliste, et que le recours à des menaces de divulgation d’informations confidentielles, quels que puissent être les griefs du magazine à l’encontre de son interlocuteur, caractérise une méthode déloyale et une intention de nuire.
