Honestly I doubt they were ever OK. Special ops forces are useful & can be used legally, but much of their work is legally & ethically troubling. Noncombatant deaths are routine.
At best, their work is incredibly brutal. I'd be very surprised to see them refusing to obey illegal orders.

The murders occurred in international waters. The victims were citizens of Venezuela, a country that is a signatory to the Rome statute. This gives the ICC jurisdiction in this case. If the murders had occurred on us soil, they would not have jurisdiction, since we are not a signatory.
