I don’t know what the Supreme Court will do, but I am confident that at the District Court level it is still the case that the Pentagon cannot recall a sitting US Senator to active duty in order to court martial him for something he said. Article 1, Section 6, among other constitutional provisions.

Wow I keep hearing this, sooo misleading. Both officers & enlisted members are bound by federal law (UCMJ, art. 90) making it a crime to disobey a LAWFUL order. BUT if either obeys an order they KNOW/should know is UNLAWFUL, they can be prosecuted for the unlawful act. Oaths have 0 bearing on this.
The answer is "no," but her response is not completely wrong. McClain is deliberately threading a needle of military lingo to confuse viewers.

This is an official statement from Secretary of Defense Pete Hegseth, who is the top civilian at the Pentagon, and thus the link in the chain of command between the President and the SOUTHCOM commander, and thus the key civilian who would be giving orders in what may soon be a war with Venezuela.
Hegseth is now threatening to recall Sen. Mark Kelly to active duty in order to court martial him.
