More judges speak to the press (the NYT) about what a disaster the Supreme Court (specifically the shadow docket) has been - “incredibly demoralizing & troubling”; a “judicial crisis”; a “slap in the face to district courts.” www.nytimes.com/2025/10/11/u...

Every time I see Trump claim vast powers over economic policy that the Constitution does not give him, often only for the Supreme Court to step in and go 'seems legit,' I can't help but think about the Court carrying on as if canceling some student loan debt was shocking executive overreach

In a trio of cases, two currently pending before the Supreme Court and one that is likely to land on the justices’ doorstep as soon as Tuesday, President Donald Trump claims new powers that, if he prevails, would give him near-total control over all US fiscal and monetary policy.
Trump asks the Supreme Court to give him total control over the US economy
The next few months could be the most consequential period for US constitutional law since the Roosevelt administration.

Whole-body-deodorant ads often imply that you stink from head to toe. But we may be losing something when we clear the smellscape, Franklin Schneider writes:
Why Are So Many People Convinced They Stink?
Whole-body deodorant is thriving. And nobody really needs it.

I know these “interviews” with Justice Barrett are carefully scripted. But if she’s going to keeping urging Americans to “read the opinions,” and not just commentary, it sure would be nice if someone would ask her what we should do when—as is so often the case these days—there’s no opinion to read…

Despite today’s outrageous ruling, we all have the right to go about our daily lives free from racial profiling by the federal government.

We will never stop fighting for our civil liberties and our immigrant communities.
Maroon graphic reading "Today's Supreme Court order puts people at grave risk, allowing federal agents in Southern California to target individuals because of their race, how they speak, the jobs they work, or just being at a bus stop or the car wash when ICE agents decide to raid a place. For anyone perceived as Latino by an ICE agent, this means living in a fearful ‘papers please’ regime, with risks of violent ICE arrests and detention." This quote is attributed to Cecillia Wang, the National Legal Director of the ACLU.

If it is not safe for Latinos to just exist in Los Angeles, it is not safe for them anywhere

The New Yorker asked me “how bad” today’s Supreme Court ruling was. I boiled it down to one paragraph:

link.newyorker.com/view/5bda429...
"Just the other day, I was in the audience at Lincoln Center when Justice Amy Coney Barrett said, while promoting a new book, that she doesn't think the United States is in a constitutional crisis," Farias told us. "Today, the Supreme Court, without offering a single line of reasoning, more or less declared that the Fourth Amendment, which protects everyone from unreasonable searches and seizures, nonetheless allows the Trump Administration to arrest and detain anyone who looks Latino, citizen or not, on account of the language that they speak or the kind of jobs they do. The ruling putatively covers the Los Angeles area, but the effect could be national," he continued.
"If that's not a constitutional crisis, then what is?"

I know there are no silver bullets here, but I think constantly about how our culture of insanely aggressive and thoughtless policing would be upended if federal and state officials were subject to individual liability for their torts instead of being protected by a vast web of immunity doctrines.
