Because in a fair hearing it should have emerged that Semenya was not comparable to female athletes but to other athletes with XY chromosomes, testes, testosterone in the male range & androgen sensitive. Aka males.

In reality, Semenya has lost the legal battle. The ECtHR did not uphold discrimination with respect to Articles 3, 8, 13 & 14. But did say Semenya had not had a fair hearing (Article 6). However, had there been a fair hearing Semenya is likely to have lost resoundingly.
