Illinois filed a supplemental brief in support of the TRO that cites directly that "plenary power" gag that Miller threw out there, and the threat to jail the Governor and the Mayor.

It is of record.

The Court cannot look away now.

From supplemental brief filed in Illinois v Trump in support of a temporary restraining order (9 October 2025) -- 

Trump issued an after-the-fact memorandum invoking 10 U.S.C. § 12406 to federalize National Guard troops that Secretary Hegseth had already deployed into Illinois. That same day,  Trump’s Deputy Chief of Staff Stephen Miller asserted the authoritarian view that the President  has “plenary authority”—sweeping and unlimited power—to federalize National Guard troops and  dispatch them to American cities like Chicago. The next day, Trump told press in the Oval Office that he might just invoke the Insurrection Act to “get around” judicial orders blocking his unlawful  troop deployments, like the one last weekend in Oregon. Then just yesterday, Trump himself posted on social media that the Governor of Illinois and Mayor of Chicago should be jailed. 

These were not empty threats. They were made even as defendants dispatched a third state’s National Guard to Illinois in federalized status, this time from California, and without any new deployment order specific to Illinois. This lawless targeting by the President and his administration of people and places he does not favor will not stop without court intervention. 

The Court can and should stop this authoritarian march. We remain a nation of laws, we have no king, and the President has no such “plenary authority” to federalize National Guard troops and deploy them into the streets of Illinois. The Court should enter a preliminary injunction against defendants’ federalization and deployment of any state’s National Guard, or deployment of U.S. military, into Illinois over the objection of its Governor.

Well, sure. Granted. Throw BYU and perhaps Notre Dame and most of the Big East Conference too -- the Catholic schools are not in the league you described but there are some no-nos. But that's shielded by Free Exercise at least, and maybe Establishment too.

Brown doesn't have that out.

Virginia State Senate Dems just brought down fire and fury regarding the “Compact,” notifying the President and Rector that UVA would lose ALL STATE APPROPRIATIONS if it signs and cedes the University to “federal political control.” Notably, their letter directly restates points made here by @siva.

Former military generals and secretaries ask to file an amicus brief in IL v Trump in support of neither side, but to explain the ramifications of violations of the Posse Comitatus Act.
4.      Given their experience, amici believe they have unique knowledge and

perspective that will aid the Court in considering plaintiffs’ motion for a temporary restraining

order and preliminary injunction against the federal defendants that seeks to enjoin federal

defendants’ federalization and deployment of members of the National Guard of the United

States, including the Illinois and Texas National Guards.

       5.      Amici offer this brief in support of neither party, but to explain based on amici’s

experience as military leaders the risks – both to the military and to the public – of violations of

the Posse Comitatus Act and framework of laws addressing military entanglement with law

enforcement, the federalization of the National Guard, and the politicization of the military.

       6.      To fully address the complex issues and risks involved, particularly as the Court

considers “what the scope of the troops' activities will be once here,” amici respectfully request

leave to file an oversized brief not longer than 25 pages.

       7.      Because of the urgent nature of this action and the expedited schedule, there was

no opportunity to seek and await a ruling from the court on the page limitation extension before

filing the brief, which is being filed contemporaneously with this motion.

       WHEREFORE, amici respectfully request that this Court enter an order granting

Plaintiffs leave to file instanter a Brief of Amici Curiae that is up to 25 pages long.
