Houston, Texas appellate attorney with side interests in progressive politics and making the world a better place

They say Democrats need good candidates all the way down the ballot. They say going progressives need to run for office, too.

I checked both those boxes off today.

I just filed to run for Texas's Fourteenth Court of Appeals, an intermediate appellate court here in Houston.

My hot take is that appellate court decisions should not be so super predictable even without any knowledge of the non-surface facts or any of the underlying case law and jurisprudence.

I'm just not fit to be a LinkedIn poster. Re-shared a post sharing a Texas Law Review article that sounded interesting to me & made some comments about bookmarking it.

I should have recognized why it sounded so interesting. We voted to publish it when I was a Texas Law Review Articles Editor.

Anyone have a theory on why SCOTUS is taking as long as it is to rule on the Texas redistricting motion to stay? (Beyond administrative stay). Just taking the time to draft opinions, or something else?

This is the type of Jewish holiday season content I come here for.

I've gotten way too many emails and texts from political campaigns about the end-of-month fundraising deadline. There is no such thing. (At least not in Texas!) A totally made-up deadline.

My other pie-discourse comment is that @k-adams-hurta.bsky.social and I had wedding pie instead of wedding cake, and we've never come close to regretting that decision. It was awesome.

I'm seeing there's some Thanksgiving pie discourse. And I'll just say what I've said before but not on this site - if you think pecan pie is bad, you're either allergic to nuts or haven't had a good pecan pie.

I have never seen an opinion like Judge Smith’s dissent in the Texas redistricting case in public before. H/t to the election law blog

Random brag: we have four oral arguments this week in Texas courts of appeals, including two by our associates Conor Harvey and Kyle Steingreaber.

Small(ish) firms, y'all, it's where the arguments are at.

Oops. Just got the date of a child's birthday party wrong. I'm sure that will happen about a million times more in parenting.

Australia's extensive solar power penetration makes so much energy that the government wants to offer free electricity at peak hours.

General advice for oral advocates (not only Sauer): The goal is not to win debaters' points or to stuff in as many answers as you can before an interjection--it's to have the sort of conversation you would have with a trusted, wise friend or colleague if you were actually trying to convince them.[7]

A broader point: don’t let people tell you SCOTUS level issues only show up in some kind of special case. They’re everywhere, and if you litigate knowing that, you can bring them to the fore.

I can't wait for these arguments in my household.
Talking to the 5-year-old about the election tomorrow has backfired spectacularly because she asked if she gets to vote, and I explained to her that she needed to be 18, and she is now crying and vigorously arguing that you should be allowed to vote “whatever age you are”
