25. Consider approving an Agreement for Funding and Limited Support between
the Fires Innovation Science and Technology Accelerator (FISTA)
Development Trust Authority and the City of Lawton, contingent upon FISTA
approving the Agreement, to fund the operation, management, administration,
maintenance and equipping of FISTA facilities during the FYE26 to
encourage economic/industrial development in the City of Lawton and
authorize the Mayor and City Clerk to execute the Agreement.

Background:
The Fires Innovation Science and Technology Accelerator Development Trust Authority
(Authority) was set up as a public trust of the City of Lawton. This Agreement for Funding and Limited Support memorializes the amount of financial support to be provided to the Authority by
the City, sets out guidelines regarding administrative support between the City and the Authority,
and sets out the conditions and processes by which this financial and administrative support will
be provided. The Agreement provides the Authority an amount of $9,087,169.30. Also included
in the Agreement are provisions associated with the Sales Tax Agreement between the Authority
and the City associated with the Series 2020 Note. The Agreement also references the
$1,000,000.00 which the City initially provided to FISTA for HUD grant reimbursement
purposes in the FY22-23 Amendment. In the FY23-24 Second Amendment, it was determined
the money would remain with the Authority so long as it is in use for any grant reimbursement
contract purposes.

Item 7 is a classic example of the way the City bundles things together, even though this is the consent agenda, so if these two appropriations where individual items, they'd still pass them with one motion.

Consent Agenda
The following items are considered to be routine by the City Council and will be enacted with
one motion. Should discussion be desired on an item, that item will be removed from the
Consent Agenda prior to action and considered separately.
7. Consider approving a resolution amending the City of Lawton FYE26 budget,
as amended, to appropriate $5,702,064.18 in ARPA funds to the Grant Fund
for the completion of the Elmer Thomas Park Aquatic Center and
$2,659,372.54 in LIDA S2024C loan proceeds to the PROPEL 2040 Capital
Improvement Fund for the US-62 Interchange Project.

SECTION 1. The City Council does hereby amend the FY 2025-2026 Budget originally
adopted on the 27th day of May, 2025, for the purpose of increasing appropriations in
account 2656001-54120 by Five Million Seven Hundred Two Thousand Sixty-Four and
18/100 Dollars ($5,702,064.18) for the completion of the Elmer Thomas Park Aquatic
Center and account 4400000-54150 by Two Million Six Hundred Fifty-Nine Thousand
Three Hundred Seventy-Two and 54/100 Dollars ($2,659,372.54) for the US-62
Interchange Project.
