MD congressmembers were illegally obstructed from oversight visits in July, but were finally permitted in August (as a federal judge in DC briefly ruled they and others were statutorily entitled, though w/OBBA funds and new legal arguments the obstruction resumed).

They handcuffed her and by late that evening she was transported to the US Immigration’s and Customs Enforcement Field Office in Baltimore, housed in the George H. Fallon Federal Building at 31 Hopkins Plaza. “I would sleep on the floor. There was a concrete structure that looked kind of like a stage, I would sleep there,” she said. She says her room had no window, she was never taken outside for fresh air or recreation. She was housed completely alone with no way to tell time. “When I was locked in there my mental health was bad,” she said. “There was a point where I was pulling my hair out. I was banging my head against the cement walls because I didn't understand. I didn't know why I was being locked up.” At first, she said she was given peanut butter and jelly sandwiches daily. But when she asked for something else, she said the guards stopped feeding her completely. She thinks she went between four and five days without food. Amaya-Luis believes her treatment was especially cruel because she is a transgender woman. WYPR spoke with multiple lawyers who said their clients were made to sleep on the ground, had no access to recreation, and had sometimes only one sandwich a day. “I was told yesterday by the person I consulted with his family member and he was being held in a room where everybody had to sleep on the floor, and there were 15 or 20 people in one room,” said Girod. Detainees report little access to phones so often calls are made to family members before they can speak with legal representation. Nilsa Yurivilca, an advocate at the Baltimore non-profit Asylee Women Enterprise, had a client who was detained for two nights in a room with 15 other men and nowhere to sleep but the floor. She did say he had a blanket. He also required insulin, which she says ICE officials took from her at an arranged drop off. Her client told her he was only fed once a day. He spent two nights in the Baltimore holding room before being sent to a detention facility in Pennsylvania, where he is held as of Thursday evening. Lopez, who works with the group in Baltimore, told WMAR there are examples of people sleeping on the floor, not provided with blankets and being overcrowded in single rooms. They are not provided the access to showers or adequate access to food, he said in a Friday interview. "These are inhumane conditions," he said. "This is not how immigrants or anyone should be treated. And this is a good moment, I think, to recall that immigration detention is a civil system. This isn't criminal detention." Lopez explained people ICE arrest in Maryland are processed at the building to later be transferred away. But he said his organization has heard examples of detainees being held anywhere from three to nine days.

In advance of a hearing this week in CM v Noem, ACLU's lawsuit over the Everglades camp, the Miami ICE Field Office shamelessly trying to duck & then quash a subpoena for testimony from its Deputy (Acting?) Director (figuring who that is at any given moment has been its own adventure the past year):
In preparation for the evidentiary hearing scheduled for January 28, 2026, and pursuant to Local Rule 3.04, Plaintiffs’ counsel provided written notice on January 13, 2026 to the Federal Defendants of their intent to call Mr. Lopez Vega as a witness at the hearing. See Declaration of Eunice Cho (“Cho Decl.”) ¶ 3 and Ex. A (Email Correspondence). In that same correspondence, Plaintiffs’ counsel asked whether counsel for the Federal Defendants would be willing to accept electronic service of the subpoena for Mr. Lopez Vega and, in addition, requested the address for Mr. Lopez Vega to otherwise facilitate service of the subpoena. See id. The Federal Defendants refused to accept electronic service of the subpoena and refused to provide the address at which Mr. Lopez Vega could be served. See id. ¶ 4 and Ex. A. Following the Federal Defendants’ refusal to accept service and to provide an address for Mr. Lopez Vega, Plaintiffs’ counsel arranged for a process server to serve the subpoena on Mr. Lopez Vega using an address found on the Federal Defendants’ website for the ICE ERO Miami Field Office in Miramar, Florida. On January 14, 2026, the ICE staff at the Miramar, Florida office refused to accept service and informed the process server that Mr. Lopez Vega could not be served at that office and had to instead be served at an office in Plantation, Florida. See id. ¶¶ 5-6 and Ex. B (Affidavit of Sedric Johnson). The next day, on January 15, 2026, the process server attempted to serve Mr. Lopez Vega at the Plantation, Florida address provided by the ICE staff on the prior day, but ICE staff at the Plantation, Florida again refused service, insisting that Mr. Lopez Vega could not be served at that address either. See id. ¶ 7 and Ex. C (Email and Photo from Michael Nolan to Eunice Cho). Instead, the process server was directed to a third office in Miami, Florida. See id. Finally, later that same day, the process server served Lina Salas, a Deputy Chief Counsel for ICE who confirmed that she had the authority to accept service for Mr. Lopez Vega. See id. ¶ 8 and Ex. D (Affidavit of Service by Henry Pinto). Service of the subpoena was therefore completed on January 15, 2026. Despite valid service and compliance with all relevant rules, the Federal Defendants have made it clear that Mr. Lopez Vega will not be appearing at the evidentiary hearing on January 28, 2026. See Cho Decl. ¶¶ 11-12. They waited over a week after service was completed on Mr. Lopez Vega to inform Plaintiffs’ counsel that he would not be present at the upcoming hearing and that they intend to move to quash the subpoena. No motion to quash has yet been filed and the Federal Defendants provided no explanation for their basis to move for any relief from the subpoena, or the date upon which they intend to file any motion to quash. Cho Decl. ¶ 12 and Ex. A.

More than a month ago, ICE's 287(g) page added a weird mention of "Tribal Task Force Model" agreements, promising that information on this previously unknown(?) arrangement and its partners would be "provided soon".

The uptake on it been so bad that they're resorting to hostage-taking?

This (initial detention for 2-3 weeks followed by lateral transfer) finally did "work" at the Everglades...for ~1-2 months. Now seeing people going into their 2nd month there.

Not sure that it did much to "speed up deportations" besides just being so abusive & miserable that people gave up, though.
Rather than shuttling detainees around the country to wherever detention space is available, as happens now, U.S. Immigration and Customs Enforcement aims to speed up deportations by establishing a deliberate feeder system, the document says. Newly arrested detainees would be booked into processing sites for a few weeks before being funneled into one of seven large-scale warehouses holding 5,000 to 10,000 people each, where they would be staged for deportation.

In Sep EOIR suddenly changed policy on virtual access to hearings, restricting non-party observation to in-person-only, at the same time wardens of (often remote) detention centers are inventing new pre-clearance reqs and "security concerns" to refuse physical access to the public courts inside.
ICE officials sought to block journalists from attending Vizguera’s bail hearing last week, an abrupt departure from what are typically open court proceedings. The warden of the detention center told reporters and one of Vizguerra’s lawyers that media and other observers were prohibited from watching because of the attention the case had received. (Officials eventually relented and allowed media into the courtroom.) Proceedings were delayed Friday morning after personnel at the detention center, which is privately run by the Geo Group, told reporters and supporters that they couldn’t enter the courtroom. It’s typically open to observers, family members of detainees and journalists who provide photo ID and go through a security checkpoint.

If I ran the numbers right (no guarantee on phone), now up to an average of >1450 over the first two weeks of December.

Lot of SFL enforcement last 2 weeks, & after seeming pretty consistent about transferring out w/in <3 weeks over Oct and Nov, seeing people hit the full-month mark this week. 😕

I assume there are reasons for it beyond tilting the field even further towards the gov through uneven discovery powers (...right?)

But the fact that we funnel people's access to their own casefile thru FOIA remains, to me, one of the most bonkers procedural "quirks" when put in removal proceedings

I'm no expert on BIA LEA structure—is this actually about deputizing willing tribal police (would there be willing tribal police?) analogous to state & local LEAs under 287(g), or just making it easier to detail other feds to the BIA doing imm. enforcement on tribal land?

Yeah, this has really struck me the last 2 weeks.

Just 1 guy in 1 court, & seen 13 respondents (+1 minor not in proceedings) targeted orally under HO ACA at MCHs over only 8 days (w/IJ side comments suggesting many more in written motions).

Only 1 case/3 (pro se ☹️) resp got OORs the day of, but...
Preliminary data indicates that many more cases have been pretermitted pursuant to the Honduras ACA than can be transferred to Honduras under the current agreement (in which Honduras committed to receive ten third country nationals per month).

One angle I don't think has been entirely reported out is the contribution of changes to, and a presumably related disruption of, ODLS right in the middle of the Herald's survey of former Everglades detainees.

The Herald ran their checks "as of the end of August", and on 8/26 ICE fucked with ODLS.
As of the end of August, the whereabouts of two-thirds of more than 1,800 men detained at Alligator Alcatraz during the month of July could not be determined by the Miami Herald. The Herald had obtained the names from two detainee rosters. Around 800 detainees showed no record on ICE’s online database. More than 450 listed no location and only instructed the user to “Call ICE for details” — a vague notation that attorneys said could mean that a detainee is still being processed, in the middle of a transfer between two sites or about to be deported.

Regarding location information for detainees held at Alligator Alcatraz, on or about September 19, 2025, DHS began implementing procedures to update detainee location information relating to aliens detained at Alligator Alcatraz to the Online Detainee Locator System (ODLS). (Parra Decl., Ex. A ¶ 5.) ODLS is a public, webbased system that allows family members, legal representatives, and members of the public to locate individuals who are detained by ICE. Id. ¶ 6. In ICE-owned facilities, detainee location information is updated in the ENFORCE Alien Detention Module (EADM) database as soon as a detainee is booked into the facility. Id. ¶ 9. Once in EADM, data is automatically uploaded to the ODLS system. Id. Although there are exceptions for certain individuals who do not appear in ODLS, ICE typically updates ODLS within eight hours of release, removal, or transfer. Id. ¶¶ 7, 10. In facilities such as Alligator Alcatraz, detainees are booked into the facility by contractors employed by the State of Florida’s Division of Emergency Management. Id. ¶ 11. ICE typically receives those facilities’ data entries daily around 8:00 a.m.; ICE officers then manually input the information into EADM, which automatically updates information in ODLS relating to transfers, release, and removal. Id. Because of the additional layer of information gathering and data entry, detainee location information relating to release, removal, or transfer at Alligator Alcatraz is uploaded to ODLS within 24 hours acknowledging delay in some instances. Two and a half months after ICE and Florida decided to make their camp in the Everglades a functional blacksite, after multiple lawsuits and innumerable suffering families and frustrated representatives, it looks like they decided to turn the ODLS switch back on overnight.

Not at all a comment on how similarly abhorrent to expect BCI towards the people inside, but I guess at least bodes a bit better for it not being quite the blackhole that the Everglades has been.
