MD congressmembers were illegally obstructed from oversight visits in July, but were finally permitted in August (as a federal judge in DC briefly ruled they and others were statutorily entitled, though w/OBBA funds and new legal arguments the obstruction resumed).

In advance of a hearing this week in CM v Noem, ACLU's lawsuit over the Everglades camp, the Miami ICE Field Office shamelessly trying to duck & then quash a subpoena for testimony from its Deputy (Acting?) Director (figuring who that is at any given moment has been its own adventure the past year):

More than a month ago, ICE's 287(g) page added a weird mention of "Tribal Task Force Model" agreements, promising that information on this previously unknown(?) arrangement and its partners would be "provided soon".

The uptake on it been so bad that they're resorting to hostage-taking?

This (initial detention for 2-3 weeks followed by lateral transfer) finally did "work" at the Everglades...for ~1-2 months. Now seeing people going into their 2nd month there.

Not sure that it did much to "speed up deportations" besides just being so abusive & miserable that people gave up, though.

In Sep EOIR suddenly changed policy on virtual access to hearings, restricting non-party observation to in-person-only, at the same time wardens of (often remote) detention centers are inventing new pre-clearance reqs and "security concerns" to refuse physical access to the public courts inside.

If I ran the numbers right (no guarantee on phone), now up to an average of >1450 over the first two weeks of December.

Lot of SFL enforcement last 2 weeks, & after seeming pretty consistent about transferring out w/in <3 weeks over Oct and Nov, seeing people hit the full-month mark this week. 😕

I assume there are reasons for it beyond tilting the field even further towards the gov through uneven discovery powers (...right?)

But the fact that we funnel people's access to their own casefile thru FOIA remains, to me, one of the most bonkers procedural "quirks" when put in removal proceedings

I'm no expert on BIA LEA structure—is this actually about deputizing willing tribal police (would there be willing tribal police?) analogous to state & local LEAs under 287(g), or just making it easier to detail other feds to the BIA doing imm. enforcement on tribal land?

Yeah, this has really struck me the last 2 weeks.

Just 1 guy in 1 court, & seen 13 respondents (+1 minor not in proceedings) targeted orally under HO ACA at MCHs over only 8 days (w/IJ side comments suggesting many more in written motions).

Only 1 case/3 (pro se ☹️) resp got OORs the day of, but...

On 8/26, the ODLS "location" for a number of detention centers switched to a new designation, "Call ICE For Details"

I don't know the full list, but I saw it at FDC Miami, Richwood, River, and Pine Prairie in [email protected] noted Richwood at the time

One angle I don't think has been entirely reported out is the contribution of changes to, and a presumably related disruption of, ODLS right in the middle of the Herald's survey of former Everglades detainees.

The Herald ran their checks "as of the end of August", and on 8/26 ICE fucked with ODLS.

Two and a half months after ICE and Florida decided to make their camp in the Everglades a functional blacksite, after multiple lawsuits and innumerable suffering families and frustrated representatives, it looks like they decided to turn the ODLS switch back on overnight.

Looks like a modest update in the system tonight, fwiw.

Not at all a comment on how similarly abhorrent to expect BCI towards the people inside, but I guess at least bodes a bit better for it not being quite the blackhole that the Everglades has been.
