The judge also set an initial schedule for pre-trial motions.

The first set is expected by Oct. 12. Per Comey’s defense counsel, that batch will include motions to dismiss for selective and vindictive prosecution, as well as a motion challenging the legality of Halligan’s appointment as US attorney

I just read a headline that says the AG’s performance yesterday mirrored his sentiment that Congress is less important than the Executive. I’m not sure that’s it — I think he feels he’s a victim and both other branches are the enemy. He fundamentally can’t deal with checks and balances.

Looks like Perpich started in District Court with Dukakis, 1988.

This will go to the Supreme Court. A few cases have in the past about Fed/State control. Perpich in 1990 (training status overseas) and Maryland in 1965 (liability for soldier actions during civil rights protests on Title 10 orders). I thought there was a Dukakis case…..hm.
