The DOJ is arguing, on behalf of the President, that the President can scoop up anyone, put them on an airplane, and then no laws apply because no court has jurisdiction.

Whether the person is a citizen wouldn't change that because there's no point they could even tell a court they're a citizen.
Wow. DOJ is arguing that the President has authority outside the Alien Enemies Act in international waters "that would not be subject to either orders."

Boasberg seems skeptical, asking if the president's foreign power exists only once the plane crosses into international airspace?

A federal court’s jurisdiction does *not* stop at the water’s edge. The question is whether the *defendants* are subject to the court order, not *where* the conduct being challenged takes place.

Were it otherwise, the government could act lawlessly overseas and courts would be powerless to stop it.

The 1952 McCarran Act under which these actions are being carried out today was heavily criticized by Jewish groups (including the ADL) as being deeply inflected by antisemitic attitudes. This 1952 piece in the Wisconsin Jewish Chronicle compared the McCarran Act to the Nuremberg Laws.

Important thread: Russ Vought had the expertise to avoid some of the legal challenges lawyers are making now. Elon has simply not GAFed.
What we got: Musk and his DOGEterage of "move fast and break stuff" nerds who believe that the APA and notice & comment are for beta males who don't take their ketamine/ steroid cocktails.
