Rule 24.01 lets courts toss lawsuits for delay, but there is NO equivalent power to dismiss an Application for delay–Courts have repeatedly held that Rule 24.01 doesn’t apply to such proceedings.
Delay remains fatal, but the legal test is far less certain

Nov 20: Justice Shore dismisses it.
Nov 21: Justice Nakatsuru grants it.
Same facts, same law, opposite results 24 hours apart.
This is why mediation should be mandatory and why no case is ever a “slam dunk.”

When a person dies holding a joint bank account, the money doesn’t automatically go to the survivor. The law assumes it still belongs to the deceased's estate, unless the survivor can prove that the deceased meant to confer a right of survivorship.

ONCA in KMH Lawyers v Kasanda (2025 ONCA 694): Lawyers can still prove solicitor-client relationship & enforce unpaid accounts even without a written retainer, if evidence is strong enough. Absent writing, counsel bear a “heavy onus” to establish the relationship.

Ontario motions to strike: A narrow, exceptional tool-NOT a quick fix for weak claims.
Courts repeatedly warn: only for pleadings with NO real prospect of success where facts are undisputed (or disputes are irrelevant). Often overused, rarely granted.
