Judge: That's what I'll do. Prohibit federalization or deployment of any NG troops into Oregon. For all reasons in prior opinion. Deployment of federalized military is ultra vires and contrary to law, violating Title 10, section 12406. I also find it's likely that defendants violate 10th Amendment.

There are going to places we disagree on policy, but I'm going to reject any attempt to create division between the two of us on this issue so long as we remain aligned on the central task ahead of us: protecting the civil rights of Portlanders from an authoritarian.

Please don't assume that Councilor Zimmerman is doing anything but working to keep Portlanders safe during this period of Federal escalation. What I have seen is care, urgency and integrity.

I would urge folks not to draw this conclusion about Councilor Zimmerman. There is a lot that goes into protecting Oregonians in this morning, and just because it’s not as visible doesn’t mean he’s not working on that. What I’ve seen gives me a lot of confidence. Please just consider that.

Under Title 10 of the US Code the NG may be federalized and placed under direct command by POTUS. Now, this specific invocation is illegal and is being challenged as such, but pending resolution of that suit the gov does not have control.

Trump’s deployment of troops to Portland is a dangerous escalation of authoritarianism. Now is the time to find our own ways of standing up and fighting back to preserve our democracy. Fellow vets: we need you to muster. And those serving: you can refuse an unlawful order as you may receive it.
