i think to understand the meaning of the birthright citizenship clause to the framers of the 14th amendment, you have to understand significance of dred scott to the civil war republican party. dred scott wasn't just a bad ruling, it was understood as a rejection of the declaration itself.

Stephen Miller says they are “actively looking at” suspending the writ of habeas corpus, which is only allowed when the US has been invaded or during an insurrection, which would not allow people to challenge their incarceration in court if they are arrested and detained.

this is such an obvious game of bullshit and it makes me insane that anyone falls for it. weird how schools are no longer "meritocratic" when they are trying to attract more black and hispanic students, but are perfectly meritocratic when they're not.
like, this is one of those things that actually drives me a little crazy. dipshits will say that we want to return to the era when merit was what mattered. but when, exactly, was that? the 1970s? the 1980s? UVA only *became* meritocratic when it became a school for all Virginians.

the constitution is a public and political document as much as a legal one and constitutional meaning is a public and political process. trump can say X but other political institutions, and the nation’s various publics, have to agree for it to mean anything

a useful thing to ask is how specifically does a rule or regulation or order go from issuance to implementation. for instance, trump has said that he will issue an executive order denying birth certificates and SSNs to the children of undocumented immigrants. okay. what happens next?

i think my position on this is that if it happens, it's unconstitutional. if the supreme court affirms it, it's still unconstitutional. it's an illegitimate and unlawful action and should be treated as such.
Apparently Trump just announced he is unilaterally ending birthright citizenship.

I would have ridiculed it as preposterous a few years ago.

Now? Well, watch the Federalist Society start holding seminars on why he’s right, and I am not confident this Supreme Court will disagree.
