Why does that matter? Because if you pass a bunch of laws and no one enforces them, your laws are worthless. Laws are not self enforcing. Thinking otherwise is how you get "but how can he do that? It's illegal!" which is something I am told every. Single. Day.

you aren't actually preventing it. I will repeat that: passing a law prohibiting something does NOT prevent it from happening. It simply means that a prosecutor or law enforcement officer MAY, but is not required to, leverage the power of the government to put you in a cage for doing it.
