Via Ballot Proposition 4 Utah voters, in 2018, voted to enact an anti gerrymandering law. The state legislature got all butt hurt about it and wrote new laws to allow them to just override the independent redistricting commission. Get fucked, Utah GOP.

But you can bet your ass is that happened I could use the bullying and harassment policy as justification for discipline. The courts said, "You can't have a blanket no misgendering policy". They didn't say, "You can't enforce your existing bullying and harassment policy to protect trans kids."

No. Most bullying and harassment policies are not hyper specific about what kind of language constitutes bullying or harassment. My school's doesn't say specifically "one student can't call another a slut for wearing a shirt that's 'too tight'".

I'd have to see the school's policy in particular, but I work in Utah where I'm legally banned from using pronouns that parents don't approve of for their kids, and my school's bullying and harassment policy covers being a shit to trans kids.

Hell, you may see the intentional misgendering of anybody at all and bullying is harassing trans kids who hear it. It just happens that, whether it's right or wrong morally speaking aside, the courts disagree with that particular position.

Whether you like the decision, think the logic is sound, or think that the first amendment shouldn't protect such speech is a different discussion from the one of "what did the courts find in this particular case?"

To be clear, nobody in this thread is saying that any form of misgendering good behavior, they are simply saying that that courts don't see it as bad enough to curtail the first amendment free speech protections that generally exist.
