The judge's subsequent written order made it more clear that the plaintiffs have technical issues with their motion that need to get cleaned up or it won't survive on appeal. The briefing this afternoon should give the lawyers an opportunity to address those issues, and from there...we'll see.

Was the issue the USIP lawyer's motion? Humphrey's Executor and Myers shouldn't cast doubt on the merits if properly presented, so I'm wondering if USIP had their ducks in a row going in or not.
