The erosion of basic principles like due process and the expanding use of our military on domestic soil puts the liberties of all Americans at risk, and should concern democrats and republicans alike.

Stirring words, but I conjecture that we need new mythologies that go beyond unreflective invocations of popular sovereignty and worship of the Constitution.

I'm glad you posted this thoughtful piece. On a critical note, deploying the "value judgment"/legal reasoning binary strikes as a facile move and one historically built up by conservatives to beat up on the Warren Court. That said the piece draws attention to less headline grabbing cases and trends.

It would be illegal and unethical to even hint at such confidential info, but... y'know...
