Everyone should listen to this oral argument. Sotomayor very clearly lays out how the end of independent rulemaking agencies will be rulemaking agencies led by the presidency. Gorsuch immediately responds that the answer is to end rulemaking agencies full stop.

The solicitor general's position seems to be "Humphrey's Executor has created confusion in the lower courts, so my solution is to say it's an agency-by-agency determination, and who knows how it turns out?"

I was not expecting the lawyer representing conversion therapy to say that it's not a medical treatment. I hope a justice will call out that he keeps distinguishing "treatment" from "conduct" from "speech" even though something can be all three. #scotus

Trump Admin being mad about Amazon showing tariffs shows that the tariff is not about economics. From an economics perspective, showing consumer the tariff cost could prompt them to search for similar goods without the tariff -- nudging them to find American producers of similar goods
