In late July, Paul Ingrassia, the White House liaison for the Department of Homeland Security, arrived at a Ritz-Carlton in Orlando with a lower-ranking female colleague and others from their department. When the group reached the front desk, the woman learned she didn’t have a hotel room.

Ingrassia then informed her that she would be staying with him, according to five administration officials familiar with the episode. Eventually the woman discovered that Ingrassia had arranged ahead of time to have her hotel room canceled so she would have to stay with him, three of those officials said.

I understand that. I'm just confused why the court didn't just say that instead of bringing the reasonable listener into the analysis (which seems muddier).

I'm still surprised the court feels comfortable saying a "reasonable listener" knows the norms of a diss track such that they don't think any of the assertions are intended to be factual. The song was widely played (in contrast to the tracks it was responding to).

As the administration goes all in on an alternate reality about portland that bears no resemblance to fact and rule of law, continuing radical (and just plain funny, ridiculing) acts of the imagination along with other ways of getting out the reality on the ground may help curb their momentum.

That last point is the one that really bugs me. The court has created an idealized "reasonable listener" that may be entirely detached from the real world.

I think I'm on board with that rule. I just find the use of the "reasonable listener" test to get there to be incoherent. Maybe that's the only place it fits, though. 🤷

I just find that shocking. Maybe my understanding of diss tracks is stunted, but I think much of what they include is intended to be literal and true. I understand why many think diss tracks should not constitute defamation, but I'm skeptical of the use of the "reasonable listener" test here.
